The lawyers representing the embattled FTX founder Sam Bankman-Fried’s lawyers petitioned the court to grant Sam Bankman a few hours daily from jail. The filing submitted by the attorneys on Monday, August 21, indicates that it would be impossible for the accused to review the voluminous discovery without leaving jail.
Court Grants Bankman-Fried Time to Meet Defense Team Outside Jail
The Monday filing sought the court directive granting Bankman-Fried a few hours to leave jail. The limited time would allow the former FTX chief executive to meet with the defense outside the jail confines.
The court granted the motion allowing Bankman-Fried a limited window starting 0830 HRS to 1500 HRS. The lawyers sought Bankman-Fried to meet the lawyers five days a week. The permit for the meetings allows Bankman-Friend’s lawyers to have a single internet-enabled laptop alongside a WiFi device.
The application by Bankman-Fried’s lawyers follows his incarceration on August 11, alleging witness tampering. He faced accusation of leaking the personal notes of the former chief executive of Alameda Research, Caroline Ellison, ultimately captured in a New York Times publication.
Judge Kaplan Issues Gag Order on Bankman-Fried Defense Team
Bankman-Fried’s lawyers attempted to convince Judge Kaplan that the action did not target intimidating the disgraced Alameda Research boss. The former romantic partner of Bankman-Fried is a key witness. The attorneys dismissed that Bankman-Fried tried tainting the jury pool. Also, the leak could neither justify nor warrant his detainment prior to the trial.
Judge Kaplan dismissed the submission by Bankman-Fried’s lawyers and decided that issuing a gag order to prohibit the former executive from addressing the media was insufficient. He directed the federal judge to impose an order restraining the executive and other participating parties from making statements capable of interfering with the fair trial.
A review of the events preceding the incarceration of Bankman-Fried features his life under house arrest. Bankman-Fried has lived in the parent’s Palo Alto – California, residence since December 2022.
Bankman-Fried’s Trial Date Draws Closer
Bankman-Fried would have restricted and monitored internet access. He would only access the websites categorized in the pre-approved by the government. The former executive would have to purchase a mobile phone that has no access to the internet.
The conditions were imposed as the trial date on October 2 draws closer. The ex-crypto exchange executive faces thirteen counts of fraud and orchestrating the FTX collapse.
The prosecutors allege that Bankman-Fried diverted billion-dollar wealth from funds to settle losses incurred by his hedge fund, Alameda Research. Besides, he faces charges of misleading investors and lenders.
He is accused of making illegal contributions to the US political campaigns leveraging his colleagues’ names.
